SMS Opt-In & Consent

Key Upside, LLC ("KeyUpside") is a licensed commercial real estate brokerage in Miami Beach, FL. This page explains our SMS program, how to opt in, the disclosures that apply, and how we record consent.

KeyUpside sends low-volume, two-way SMS to commercial real estate brokers — and the transaction contacts they designate — that we are actively coordinating a specific listed property with. Messages are used to schedule property showings, coordinate third-party due-diligence inspections, exchange diligence documents (rent rolls, T-12s, leases), and coordinate Letters of Intent.

This is informational / transactional business-to-business communication between licensed professionals — not marketing or promotional messaging. Consent is per-transaction, voluntary, and is not a condition of doing business with KeyUpside.

KeyUpside does not sell, rent, or share mobile phone numbers or SMS opt-in and consent information with any third parties or affiliates for marketing or promotional purposes. See our SMS Terms (Section 20) and Privacy Policy (Section 15).

How to opt in

Consent to text is captured in two logged ways. Both require your affirmative agreement before we send any message.

Online opt-in form

Complete the form below. You submit your name and mobile number and check an unchecked-by-default consent box. Each submission is timestamped and stored as our consent record.

Verbal opt-in on a call

On a call about a specific property, a KeyUpside representative reads the script below and logs your spoken "yes" with the date, time, representative name, and property.

"Is it OK if I coordinate this deal with you by text? You'll only get messages about this transaction. Message frequency varies, message and data rates may apply. Reply STOP to opt out and HELP for help."

How we record consent

Every opt-in — web or verbal — is stored as a timestamped record. Each record captures:

  • calendar_today Date & time of consent
  • person Name of the consenting individual
  • smartphone Mobile number
  • home_work Property / transaction reference
  • description Exact consent language agreed to
  • source Source (web form or logged verbal)
